Terms & Conditions

These terms govern the use of this website and any engagement with Siva Kumar M S. Where a signed proposal or contract says something different, that document takes precedence.

Who you are contracting with

Services are provided by Siva Kumar M S, operating from Thiruvananthapuram, Kerala, India. Contact details are at the bottom of this page and on the contact page.

Engagements

Work begins from a written proposal setting out scope, deliverables, timeline and price. A proposal becomes binding when you accept it in writing and make the first payment.

Anything outside the agreed scope is quoted separately before it is started. You will not receive an invoice for work you did not agree to.

Payment

Prices are quoted in Indian Rupees and, unless the proposal states otherwise, exclude applicable taxes. Payment terms are set out in the proposal; typically a deposit before work starts and the balance on delivery.

Invoices are due within 14 days of issue. Work may be paused on overdue invoices after written notice.

Refunds are governed by the cancellation and refunds policy.

Your responsibilities

  • Supplying content, access and approvals within the timeframes agreed. Delay here moves the delivery date.
  • Warranting that any material you provide is yours to use, and does not infringe anyone else’s rights.
  • Nominating one person with authority to give approvals, so feedback does not arrive contradicting itself.

Intellectual property

On final payment, ownership of the work produced for you transfers to you. Until then it remains mine.

Pre-existing tools, libraries and components I bring to the project stay mine, and you receive a perpetual licence to use them as part of the delivered work.

Unless you ask otherwise in writing, I may show the work in this portfolio and describe my role in it. Anything you mark confidential is excluded.

Warranties and liability

Work is delivered with reasonable skill and care. Defects reported within 30 days of delivery are fixed at no charge where they fall within the agreed scope.

Nothing is warranted to be error-free, uninterrupted, or fit for a purpose that was not stated. Liability for any claim is limited to the fees paid for the engagement that claim relates to, and does not extend to indirect or consequential loss including lost profit or lost data.

Nothing here limits liability that cannot be limited under Indian law.

Third-party services

Projects commonly rely on third-party services — hosting, payment gateways, model providers, analytics. Those services have their own terms and their own availability, and I am not responsible for their outages, pricing changes or discontinuation.

Use of this website

This site is provided for information. You may not scrape it at a rate that degrades it for others, attempt to gain unauthorised access to any part of it, or reproduce case study content as your own.

Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Thiruvananthapuram, Kerala.

Changes

These terms may be updated. The date at the top of this page reflects the current version. Changes do not apply retroactively to an engagement already underway.
